A BILL TO BE ENTITLED AN ACT relating to a jury's role in preventing disproportionate punishment in criminal cases. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION . A jury in a felony punishment hearing is entitled to render a lesser punishment than otherwise would be required by the application of sentence enhancements if the jury unanimously agrees that such enhancement would result in a sentence disproportionate to the severity of the crime. |
